Former Reds laud conviction of Satur, Ocampo, 11 others
ASUNCION, Davao del Note – A group of former cadres and members of the CPP-NPA-NDFP yesterday lauded the conviction of former Bayan Muna party-list Rep. Satur Ocampo and Alliance of Concerned Teachers (ACT-Teachers) Rep.France Castro for child kidnapping charges.
“The court decision is a crucial step toward justice for the lumads (indigenous peoples) of Talaingod, who have long been exploited by false promises of radical change,” KalinawSoutheastern Mindanao Region said in a statement.
The Tagum City Regional Trial Court Branch 2 on Friday found Castro, Ocampo, and 11 others guilty of violation of Section 10(a) under Republic Act 7610 or the Special Protection of Children Against Abuse, Exploitation, and Discrimination Act and meted imprisonment from four years to six years.
The court's 25-page ruling also ordered Ocampo, Castro,and 11 others to pay P10,000 each for civil indemnity and moral damages to each minor, plus 6% annual interest until fully settled.
“Records reveal that the prosecution has established proof beyond reasonable doubt that [the] accused… committed acts detrimental to the safety and well-being of the minor lumad learners,” the ruling read.
Acquitted were Pastor Edgar Ugal, Rev. Ryan Magpayo, Eller Ordeniza, and Rev. Jurie Jaime for the prosecution’s failure to prove their guilt beyond reasonable doubt.
Trafficking charges stemmed from the involvement of Ocampo, Castro, and 17 others in a November 2018 solidarity mission in Talaingod, Davao del Norte, where they were accused of holding 14 minors. The mission was allegedly aimed to assist IP schools and teachers and investigate human rights abuses following the padlocking of the Salugpongan Community Center by the paramilitary group ALAMARA.
“Historically, the activism and unity of the Manobo and other lumad tribes have demonstrated the power of collective action and political awareness. However, this activism was often diverted by the CPP-NPA-NDFP from achieving tangible benefits for the Lumad to serving political agendas aimed at dismantling the government,” Kalinaw SEMR said.
It added: “Despite this, the significance of legitimate activism by the Manobo and Lumad tribes remains undeniable.”
The statement said, “This legal development serves as a sobering reminder of the real victims in this saga—the Lumad of Talaingod and other Lumad communities who have been historically victimized by both sides for decades.”
Far from over
While the court’s decision marks a positive step towards justice, Kalinaw SEMR said the healing and reconciliation of Talaingod's wounds from its bloody past are far from over.
It said the indigenous peoples have already spoken against the influence of the CPP-NPA-NDFP in their communities and have chosen to return to the folds of the law and abandon armed struggle.
The group urged the government to continue prioritizing the protection of IP rights, providing culturally tailored education, and establishing healthcare services for their specific needs.
“Implementing sustainable livelihood programs and improving infrastructure, including roads, communication networks, and clean water, are likewise essential. It is also crucial to ensure land tenure security and protect ancestral domain while promoting and preserving cultural heritage” Kalinaw SEMR said. Encouraging political participation and representation at local and national levels will also ensure their protection, empowerment, and development.
Clarion call
It added that the court's decision is also a clarion call for comprehensive reform and challenges the people to confront historical injustices and commit to lasting solutions.
By addressing the multifaceted needs of the IP communities, Kalinaw SEMR said the country can pave the way for their genuine empowerment and integration into the broader fabric of our society.
“This moment demands unwavering dedication to fostering a future where the lumads can thrive with dignity, their rights fully protected, and their voices heard and respected in the corridors of power. The journey towards true justice and lasting peace is arduous, but with collective resolve, it is an achievable reality,” it said.
